1. Acceptance of Terms

By using Ghostonix services, you agree to these Terms.

 

2. Scope of Services

We provide consulting, digital, AI, and related services as agreed in contracts or invoices.

3. Payments & Refunds

All fees are due upfront unless agreed otherwise.

All payments are final and non-refundable.

Failure to pay = suspension of services.

Chargebacks & Disputes:

All payments to Ghostonix are permanent, final, and strictly non-refundable under any circumstances. By proceeding with payment, you acknowledge and agree to these Terms in full. Clients are strictly prohibited from initiating chargebacks or disputes through their bank or card provider. Any attempt to reverse or dispute a payment will result in immediate and permanent termination of all services and may be pursued through legal or collection action to recover the full amount of the payment, processing fees, dispute fees, and additional damages. this includes but not limited to payments powered by Stripe.

4. Client Responsibilities

Clients must provide accurate info, comply with laws, and not misuse our services. Any false info or unlawful use = immediate termination without refund.

 

5. Company Rights

We reserve the right to:

Accept or decline any project.

Modify, suspend, or terminate services anytime.

Subcontract to trusted third parties.

 

6. Intellectual Property

All deliverables remain Ghostonix property until paid in full. Unless transferred in writing, all IP belongs to Ghostonix. Clients receive only a limited, non-exclusive license to use deliverables.

7. Limitation of Liability

Ghostonix is not liable for indirect, incidental, punitive, or consequential damages.

Our total liability never exceeds the amount paid for the specific service.

8. Indemnification

Clients agree to defend, indemnify, and hold Ghostonix harmless against all claims, damages, or expenses arising from their use or misuse of our services.

9. Confidentiality

All non-public information remains confidential unless disclosure is legally required.

 

10. Non-Disparagement

Clients may not publish or encourage defamatory content against Ghostonix. Violations may result in legal action.

11. Dispute Resolution

All disputes shall be resolved exclusively in arbitration in New Mexico, under AAA rules. No class actions allowed.

12. Force Majeure

We are not liable for delays or failures caused by events outside our control (war, cyberattacks, disasters, supply failures).

 

13. Entire Agreement

These Terms + any signed contracts = the full binding legal agreement.
